Inequitable Conduct and the Duty of Disclosure

The duty of disclosure before the U.S. Patent Office and the associated defense of inequitable conduct in the courts are ones for which patent practitioners must constantly stay knowledgeable.  While some things remain constant with the duty and defense, nuances continuously evolve.  This panel brings a perspective from both the litigators’ and prosecutors’ points of view, with particular focus on the state of the law after GS Cleantech, the nuanced differences between the scope of the duty of disclosure between different Patent Office forums, and best practices and tips from the patent prosecutor’s perspective.  

Gordon Arnold

Gordon Arnold received his Bachelors of Science in Electrical Engineering from the University of Texas and his JD from the University of Houston College of Law. He is the managing partner at Arnold & Saunders, LLP, a firm he started in 1996. Gordon served as the Chair of the American Bar Association Section of Intellectual Property Law where he was also the Chair of the Patent Policy Committee. For many years, he represented the ABA in congressional meetings on funding of the Patent and Trademark Office and patent reform legislation. During that time, he was invited by the U.S. Senate to teach congressional staffers how differently plaintiffs and defendants would interpret language that had been proposed for the new statute. Gordon has also been President of the Houston Intellectual Property Law Association, Chair of the Patent Law Committee of the American Intellectual Property Law Association, and a Board Member of that organization. Gordon is also a Founding Master of the Houston Intellectual Property Inn of Court, which is an organization of judges and lawyers devoted to the encouragement of civility and quality of advocacy in the courts.

Keith (Ron) Derrington is a Counsel in the Houston office of Bracewell LLP, and his practice has an emphasis on patent preparation and prosecution.  Prior to entering the legal field, Ron worked as a NASA reliability engineer and also as a systems engineer designing petrochemical facilities.

Justin Hendrix serves as IP counsel at Collins Aerospace, a unit of Raytheon Technologies Corp.  In his current role, Justin has responsibility for all IP matters for the Aerostructures business, including managing the global patent and trademark portfolios, IP litigation, licensing, joint development agreements, and IP in government contracts and commercial transactions.  Prior to his current role, Justin spent nearly a decade in private practice at the law firm of Finnegan, Henderson, Farabow, Garrett & Dunner LLP.  Before beginning the practice of law, Justin served in the U.S. Navy’s submarine force.

Luke McCammon is a partner in Finnegan’s Washington DC office. Luke focuses his practice on patent litigation in U.S. district courts and at the U.S. International Trade Commission (ITC), with a particular emphasis on computer, software, and medical device technologies. In addition to his patent litigation practice, Luke has substantial experience with post-grant proceedings at the U.S. Patent and Trademark Office (USPTO).
